    BYBIT TR RISK DISCLOSURE STATEMENT

     

    This risk disclosure statement (this “Statement”), has been prepared by Bybit Kripto Varlık Alım Satım Platformu Anonim Şirketi (Hereinafter referred to as “Bybit TR”) to provide information about the risks related to Crypto Assets and is an integral part of the User Agreement.

    1. Crypto Assets, have their own special risks that differ from the traditionally known risks related to national currencies, commodities, securities or other financial instruments. For this reason, Users must understand the legal, economic and tax-related characteristics of Crypto Assets, research and know the status of these assets in front of legislation.

     

    1. It is the User's obligation to research and learn about the risks specific to Crypto Assets. In this regard, Bybit TR does not have any obligation to provide any clarification or consultancy separately and specifically.

     

    1. Platform Services containing Crypto Assets carry a high level of risk and are not suitable for many investors. Users can make a profit as a result of trading transactions in Crypto Assets, as well as suffer losses, and as a result, they may lose all of their investments. Therefore, before deciding to carry out your transactions, you should understand and recognize all the risks in the market; you should make a decision taking into account your financial situation and limitations.

     

    1. Bybit TR provides Users with general information about the risks associated with these products and services with this Risk Disclosure Statement, but this form does not contain all the risks that will arise from transactions, nor does it undertake that it contains information about risks related to the personal circumstances of Users.

     

    1. If you have any doubts about anything, you should get professional consultancy services. Before deciding to make a transaction on the Bybit TR Platform, it is important that you fully understand the relevant risks, have sufficient financial resources and financial literacy to take these risks.

     

    1. There are risks such as; termination of the network where Crypto Assets are traded, withdrawal of developers from the project, withdrawal of approvers from the network, depreciation of Crypto Assets, prohibition of Crypto Assets and/or related transactions by any state, official, administrative authority or legal authorities, implementation of measures, blocking. The obligation to conduct the necessary research and make decisions in these matters belongs only to the User.

     

    1. Values in the Crypto Asset markets are extremely unstable and volatile. The value of these can change quickly. Users must understand the risk of how they may be affected by these sudden and negative changes and act accordingly.

     

    1.  Prices in the Crypto Asset markets are determined in accordance with supply and demand.

     

    1. Bybit TR is only an intermediary for your Crypto Asset trading transactions and is not the issuer, operator, manager or owner of any crypto asset in any way.

     

    1. Crypto Asset markets have variable levels of liquidity. Although some of them are quite liquid, the trading volume is lower in some of them. Markets with low liquidity may increase volatility. Bybit TR does not make any commitments or guarantees about the purchase and sale of a crypto asset that can be traded on the Platform.

     

    1. The User is responsible for the security of the User Account and must securely protect the password and/or other information used to access the user account. In addition, the User should make sure that he can monitor the status of his account at all times. Because each User is solely responsible for the security of their account. Bybit TR is not responsible for tracking the positions in any User's account.

     

    1. The User is fully responsible for the transfer of Crypto Assets to Crypto Asset wallets. The User is also responsible for taking security measures related to these wallets. If a crypto asset is transferred to a wallet belonging to a different User, Bybit TR cannot be held responsible for this transaction; all responsibility belongs to the User who made the incorrect transfer. Again, according to the technical characteristics of Crypto Assets, the User is also responsible for incorrect transfers that occur due to incorrect entry of information that must be entered during the transfer.

     

    1. Crypto Assets are non-refundable and irreversible after the transfer transactions have been performed. Therefore, it is your obligation to check the accuracy of the wallet address where you will make the transfer. All responsibility arising from the fulfillment of the orders given by the User belongs only to the User.

     

    1. System errors may occur while processing transactions on the platform and/or in our applications. The User is aware of the risk that his orders may be delayed or deemed invalid due to a malfunction caused by the system. The User understands and accepts the risks associated with failure of hardware, software and internet connections, risk of malware entry, risk of unauthorized access by third parties to information and/or digital assets stored on behalf of the user, cyber attack, Crypto Asset network failure, computer viruses, communication errors, disruptions, errors, corruptions, delays, spyware, scareware, trojans, worms that a user may encounter when trading through the services or the risks associated with using an internet-based trading system, including, but not limited to, worms or other malware that may infect your computer or other equipment or possible phishing, spying or other attacks.

     

    1. Bybit TR may cooperate with third parties offering fiat currency and Crypto Asset services. There is no special legal protection that guarantees damages arising from the payment paid by the User to the third party if the cooperating third party damages the User, becomes bankrupt, partially or completely temporarily suspends its activities, or permanently stops them. Bybit TR will not be responsible for damages caused by third parties.

     

    1. Bybit TR may partially or completely freeze your account for a certain period or indefinitely, partially and/or completely block transfers to your account, close your account, prevent the use of cash in your account, or apply measures to your Crypto Assets for legitimate reasons or if it has a reasonable suspicion that you are engaged in suspicious activity, violating the law or the User Agreement.

     

    1. The User assumes sole responsibility for the tax consequences that will arise due to the realization of the Platform Services. The user is solely responsible for all tax obligations (withholding, collection, reporting, paying and/or remittance) to the relevant tax authorities.

    1. Crypto Asset transfers cannot be refunded, and in this context, the fees paid by the User to Bybit TR for transactions cannot be refunded.

     

    1. Opinions, news, research, analysis, prices or other information contained on the Platform are presented as general market commentary and do not constitute investment advice. Bybit TR is not responsible for losses arising from any investment based on any content provided.

     

    1. The User accepts, declares and undertakes that he/she has read, understood and accepted all these risks before using the Platform and the services. This form has been submitted for the User's access and permission before the User becomes a member. In addition, if requested, it will be sent to the User's e-mail account registered with Bybit TR.

     

    1. This form has been prepared in Turkish and English languages and if there is a difference between both versions, the Turkish version will be taken as the basis.
